Texas House Passes Representative Leach's Constitutional Amendment Banning the Imposition of a State Income Tax

AUSTIN - Last night, the Texas House of Representatives adopted House Joint Resolution 38, a constitutional amendment authored by Representative Jeff Leach that bans the imposition of a state income tax on individuals and businesses in Texas. State law prescribes constitutional amendments to receive a 2/3 majority from each legislative chamber. Accordingly, House Joint Resolution 38 passed the Texas House of Representatives with a final vote of 100-42, and is now headed to the Texas Senate for consideration. If approved by a 2/3 majority in the Texas Senate, Texas voters will have the opportunity to ratify this measure on the ballot during the next General Election on November 5, 2019.

Upon the resolution's final passage, Representative Leach issued the following statement: "Texans overwhelmingly reject the notion of a state income tax, and with the passage of HJR 38, the Lone Star State is sending a strong message that the money earned by hard-working Texans is best secured in their own pockets and best spent at their own volition."

Earlier this year, the Texas Tribune & the University of Texas conducted a joint poll where Texans were surveyed on the creation of a state income tax to provide an additional funding source. Accordingly, 71% of respondents opposed the creation of a state income tax. Further, the University of Houston Hobby School of Public Affairs reported findings from another recent survey of Texas voters, revealing that 76% of Texans reject the imposition of a state income tax as an additional funding source.
Born and raised in Plano, Representative Leach graduated from Plano Senior High School before attending Baylor University. He earned his law degree from Southern Methodist University’s Dedman School of Law and currently practices at the Texas law firm of Gray, Reed & McGraw LLP. Most recently, Leach was selected by Speaker Dennis Bonnen to serve as Chairman of the House Committee on Judiciary & Civil Jurisprudence, and was named to serve on the House Committee on Pensions, Investments & Financial Services and the House Committee on Redistricting. In addition, Representative Leach was appointed to the State Preservation Board and serves on the Texas Judicial Council. Jeff and his wife Becky, an author, speaker and artist, are the proud parents of Brady (age 11), Charlotte (age 8) and Landry (age 4). They are active members of Prestonwood Baptist Church in Plano, where they have served for several years in the Young Families Ministry.
